5. SMS / Text Messaging & Communications
When you provide your mobile phone number and consent to receive text messages, we collect and store your mobile number, your consent (including date, time, and method of consent), and records of all text messages sent and received.
Purpose of SMS Communications: We use your mobile number and SMS consent to send messages relating to: application status updates, funding approvals and offers, account reminders, repayment notifications, and, where separately consented, promotional messages about our products and services.
Record-Keeping: We maintain records of your SMS opt-in consent in compliance with TCPA requirements and CTIA guidelines. These records include the source of consent, the date and time of opt-in, and the exact disclosure language presented at the time of consent. These records are retained for a minimum of five (5) years or as required by applicable law.
Opt-In Data: Your mobile number and SMS opt-in status will not be sold, rented, or transferred to any third party for their own marketing purposes. Mobile opt-in data is used solely in connection with the Swift Green Capital SMS Program and is not shared with any third party except as necessary for the operation of the SMS program (e.g., our SMS platform provider) or as required by law.
Opt-Out: You may opt out of SMS communications at any time by replying STOP to any text message. After opting out, you will receive a single confirmation message and no further texts will be sent to that number for marketing purposes. Transactional messages related to an active financing agreement may continue as necessary and permitted by law.
7. We Do Not Sell Personal Information
Swift Green Capital does not sell, rent, trade, or otherwise transfer your personal information to outside parties for their own commercial or marketing use. This includes the mobile phone numbers and SMS opt-in data collected through our website and application forms. We do not share opt-in data with any third parties for marketing purposes.
We may share anonymized, aggregated, or de-identified data that cannot reasonably be used to identify you with third parties for analytics, research, or business purposes.
8. Data Retention
We retain your personal and business information for as long as necessary to fulfill the purposes for which it was collected, to comply with our legal obligations, resolve disputes, and enforce our agreements. Specifically:
- Application data (approved or declined): retained for a minimum of 5 years;
- Active customer financial records: retained for the duration of the financing relationship plus 7 years;
- SMS opt-in consent records: retained for a minimum of 5 years from date of opt-in or opt-out;
- Call recordings: retained for 90 days unless otherwise required by law;
- Website analytics data: retained for 24 months;
- Declined application data: retained for 2 years.
Following the applicable retention period, we will securely delete or anonymize your information in accordance with our data disposal procedures.
9. Data Security
We implement industry-standard technical, administrative, and physical safeguards designed to protect your information from unauthorized access, use, alteration, and disclosure. These measures include:

16. Opting Out of Communications

Marketing Emails: Click "Unsubscribe" in any marketing email or contact us at admin@swiftgreencapital.com. You will still receive transactional emails necessary to manage your account or financing.
Telephone Calls: Contact us at admin@swiftgreencapital.com to be added to our internal do-not-call list. This does not affect your right to place you on the National Do Not Call Registry. Note: if you have an active account or application, we may still contact you about account matters.
17. Data Transfers
Swift Green Capital operates within the United States. If you access our Site or services from outside the United States, please be aware that your information may be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your country of residence. By using our Site or services, you consent to any such transfer.
